          Miss Grand International Public Company Limited (the “Company”) recognizes the importance of personal data and respects the rights of data subjects. This Privacy Notice (“Privacy Notice”) is prepared to explain the Company’s policies, methods, and purposes for collecting, using, disclosing, and/or transferring personal data abroad (“Processing of Personal Data”) in accordance with the Personal Data Protection Act B.E. 2562 (2019) and relevant laws (“Personal Data Protection Laws”), as well as the Company’s policies and operational procedures concerning data security.

          This Privacy Notice is intended to demonstrate the Company’s transparency and fairness in processing personal data and to ensure that your data will be used only for the specified purposes and in accordance with the law.

This Privacy Notice applies to the following individuals:

          Please read this Privacy Notice carefully to understand the Company’s purposes for processing your personal data.

1. Sources of Personal Data Collection

          “Personal Data” means any data that can directly or indirectly identify you (excluding data of deceased persons).

Sensitive Personal Data

          (as per Section 26 of the PDPA) will only be collected, used, disclosed, or transferred abroad with your explicit consent or as permitted by law.

Examples of collected personal data include:

• (1) Data from the Miss Grand Thailand application form: full name, address, phone number, email, guardian info (for applicants under 20), social media, birthdate, age, gender, marital status, weight, height, national ID number.

• (2) Photos and video recordings.

• (3) Educational background, qualifications, academic records, achievements, talents.

• (4) Cookie data, as per the Cookie Policy.

Refusal to provide required personal data may result in the inability to proceed with agreements or access services.

2.2 Third-Party Personal Data
          If you provide the Company with third-party data (e.g., spouse, children), you must inform them about this Privacy Notice and obtain their consent if required.

3. Purposes and Legal Basis for Processing Personal Data

• 3.1. To carry out requests before entering into a contract or to perform contractual obligations (e.g., employment agreements).
• 3.2. To comply with laws and regulations (e.g., labor laws, social security, health and safety).
• 3.3. For legitimate interests (e.g., HR management, benefits administration, financial operations, communication, documentation).
• 3.4. To protect vital interests (e.g., emergency contact, disease control).
• 3.5. For purposes where you have given your consent.

4. Processing of Sensitive Personal Data

          If necessary, the Company may process sensitive data (e.g., medical conditions, allergies, medical certificates) for providing health-related benefits or assessing competition eligibility. Such processing will be done with your explicit consent or as legally required, with appropriate security measures in place.

5. Your Rights as a Data Subject

          According to the PDPA, you have the following rights:

• 5.1. Right to Withdraw Consent at any time (without affecting prior lawful processing).
• 5.2. Right to Access and request a copy of your data or information on its acquisition.
• 5.3. Right to Rectify inaccurate or incomplete data.
• 5.4. Right to Erasure of data no longer necessary or unlawfully processed.
• 5.5. Right to Restrict Processing during disputes or verification.
• 5.6. Right to Data Portability to another data controller.
• 5.7. Right to Object to data processing for legitimate interest, public tasks, direct marketing, or scientific/historical/statistical research.
• 5.8. Right to File a Complaint with the Personal Data Protection Committee for non-compliance.

Note: The Company may lawfully deny certain rights under defined criteria and will inform you of the reasons.

6. Disclosure of Personal Data

          The Company may disclose your personal data to:

• (1) Entities within its corporate group, directors, employees, agents, consultants.

• (2) Government agencies and regulators (e.g., Anti-Money Laundering Office).

• (3) Business partners, agents, auditors, under legal basis and adequate safeguards.

• (4) Financial institutions, as required by law.

• (5) Service providers (e.g., cloud providers, subcontractors).

• (6) Social media providers.

• (7) Authorized representatives or legal agents.

7. Cross-Border Data Transfers

          Data may be transferred abroad to service providers or cloud processors with security standards equal to or higher than Thailand’s. If not, the transfer will comply with the PDPA and appropriate safeguards will be implemented.

          Personal data will be retained only as long as necessary to fulfill the stated purposes, or longer if required by law.

9. Data Security

          The Company implements appropriate security measures to protect against unauthorized access, loss, alteration, or disclosure. Third-party processors are contractually bound to confidentiality and compliance with security measures.

          This Privacy Notice may be amended or updated from time to time. Updates will be announced on the Company’s website https://missgrand.com and other official channels. If changes significantly impact your rights, you will be notified in advance.
